The flowchart above outlines the General Development (GD) title protocols. A detailed outline is available through the link above. Land title issues impact all areas of development, including residential, commercial, and renewable projects, and adhere to the same checklist.

 

Achieving clear title is vital for mitigating risks, ensuring transactional confidence, and enforceability. This requires a thorough investigation of three factors: (1) Survey Issues, (2) Physical Encumbrances, and (3) Outside Claims. Each area can lead to confusion and legal disputes, from conflicting surveys to undisclosed easements and inheritance claims.​

With 15 years of experience in development due diligence, I have identified effective protocols to rectify title defects, leaving behind a clean and insurable title. 

​

To secure capital, a documented workflow is crucial. This begins with retrieving and reviewing documents from County Recorder and Assessor sites, followed by chain-of-title analysis and inspections. The process may include in-person historical research until the authentic governing source is found. Closing these loops of detection, escalation, documentation, and legal resolution confirms a marketable and insurable title.
